Injured in an Uber Eats, Grubhub, DoorDash, Amazon, or other type
of delivery driver accident? DLG will fight to help you recover maximum financial compensation.

Los Angeles Delivery Driver Accident Lawyer

Delivery is king at the present time. Whether it’s prepared food, groceries, or household items, everyone wants to receive what they want or need as quickly and efficiently as possible.

As a result, many accidents happen when drivers are making deliveries. A delivery person can be struck as a pedestrian by oncoming traffic or as a driver while en route. Additionally, delivery drivers can be at-fault parties in any number of scenarios – whether striking a pedestrian, driver/vehicle, or property.

Important 2022 DoorDash Delivery Driver Questions and Answers:

So, what happens after a delivery driver accident occurs (whether for pizza, Uber Eats, Grubhub, DoorDash, Instacart, Amazon, or Postmates)?

Let’s look at what options delivery drivers have for filing a civil claim seeking financial compensation after an accident or injury on the job. We’ll also look at what to do if you’re struck and injured by a delivery driver. Finally, we’ll discuss how to file a claim with Dordulian Law Group to recover all applicable financial damages for your delivery driver accident injury.

What is a Delivery Driver Accident?

A delivery driver accident can involve a number of different scenarios. Some of the most common types of delivery driver accidents include:

  • Delivery drivers being struck by at-fault drivers while operating their vehicles
  • Delivery drivers being struck by at-fault drivers while making a delivery (as pedestrians)
  • Private drivers being struck by at-fault delivery drivers
  • Pedestrians being struck by at-fault delivery drivers
  • Property being struck and damaged by at-fault delivery drivers

Delivery drivers often use the middle lane to stop and make deliveries. This can cause various types of traffic accidents as well as put the driver in danger when making a delivery as a pedestrian. But delivery drivers are also more likely to be involved in car accidents simply because of the amount of hours they spend on the roads and highways each day.

Additionally, delivery drivers can make common mistakes when rushing to make a food or product delivery. Whether they’re speeding, distracted, or drowsy from long shifts, delivery drivers are prone to being involved in automobile and pedestrian accidents.

Do Delivery Drivers Have Insurance Coverage?

Do Delivery Drivers Have Insurance Coverage?
Delivery driver insurance can vary depending on the company where you’re employed. Some standard insurance coverage policies for popular delivery companies include:

  • Amazon Insurance: Amazon’s employee insurance policy states that for package pickups originating in California, the company provides occupational accident insurance to cover on-the-job injuries. This coverage pays for medical expenses and lost income resulting from covered injuries while delivering with Amazon Flex. The company policy includes:
    • – Medical expenses incurred, up to $1,000,000
    • – Disability payments equal to 66% of your average weekly earnings, including tips, from all delivery and transportation companies as defined by the law subject to minimum and maximum limits
    • – Burial expenses up to $10,000
    • – Accidental death insurance for the benefit of spouses, children, or certain other dependents, for covered injuries suffered while you are using the Amazon Flex app and working for Amazon Flex
  • DoorDash Insurance: DoorDash’s liability policy includes up to one million dollars in coverage when drivers are involved in accidents. DoorDash requires all drivers to carry personal auto insurance policies that are kept up to date. In an instance where a DoorDash driver fails to maintain their personal policy, the company’s insurance coverage may not apply when an accident occurs. In fact, DoorDash’s driver agreement stipulates that the driver’s insurance policy is the primary source of coverage.

If an accident involving a serious injury occurs and exceeds the driver’s insurance policy limits, DoorDash’s company policy may cover the additional damages. But such a scenario only includes accidents where the delivery driver was on an active delivery (and DoorDash defines an active delivery as one “where the driver has goods in their vehicle to be delivered.“)

  • Uber Eats Insurance: An Uber Eats policy includes a $50,000 limit per individual and a $100,000 limit per accident involving a bodily injury. Additionally, their policy includes up to $25,000 for any property damage caused by one of their drivers. When an Uber Eats driver is on an active delivery, the liability coverage actually increases to one million dollars. And Uber Eats defines an active delivery as “accepting a request and being on the way to pick up the food or being on the way to deliver it.” It is only when the delivery driver displays as ‘available’ on the app but has not actually started the process of making a delivery that Uber Eats would reduce the million dollar policy limit (some coverage will likely be extended in such cases, but an exact number can’t be determined).
  • Postmates Insurance: For third-party liability claims, Postmates offers insurance coverage up to one million dollars. However, the driver has to be in the process of making an actual delivery for the policy to be valid. When the Postmates driver exceeds his or her personal auto insurance policy limits, the Postmates company insurance policy will become in effect.

Postmates recently started offering drivers what’s known as an Occupational Accident Insurance benefit – covering some medical expenses and disability benefits in the event of an accident. If an accident occurs at any point between a Postmates driver accepting a food order and finally delivering it to its destination, drivers may be eligible for coverage for any injuries sustained in an accident.

That said, all Postmates drivers must still maintain their own insurance policies, and drivers waiting for a patron to assign a delivery are not covered by company insurance.

  • Pizza Delivery Driver Insurance: Pizza delivery driver policies can vary considerably depending on the company employing the worker. In some cases, pizza delivery drivers are independent contractors. In other cases, drivers may be considered actual employees of the company and therefore covered under their insurance.

But the vast majority of pizza delivery drivers, particularly here in California, are expected to carry their own auto insurance policies. If you’re a pizza delivery driver who was injured in a collision, Dordulian Law Group’s (DLG) car accident experts can help you file a claim to secure maximum financial compensation.

What if I Was Hit by a Delivery Driver?

After receiving medical attention (which is the absolute most important step after being involved in any type of car accident), it’s important to consult with an experienced personal injury lawyer before making any statement to either the insurance company, at-fault party, or police.

If you were injured by a delivery driver, the facts of the case will dictate how DLG’s experienced attorneys will proceed. When you complete your free consultation, we’ll review all available options, discuss how much your case might be worth, and provide a legal strategy for moving forward with a valid claim.

What if I’m a Delivery Driver Who Was in an Accident?

Again, after first receiving medical attention, it’s important to not make any statement to either your company/employer, the insurance company, the police, or the at-fault party before first consulting with an experienced personal injury lawyer from DLG. We’ll review the facts of your case, launch a thorough investigation led by our in-house Chief Investigator (a retired LAPD Central Traffic Division Detective, Moses Castillo), and develop a legal strategy that’s both aggressive and precise for your valid claim.

Important 2022 DoorDash Delivery Driver Questions and Answers:

  • I was in an Accident with a DoorDash Driver. What do I do?

After an accident with a DoorDash driver, it’s recommended that you contact the delivery company via telephone or directly through their app. Doing so immediately after an accident establishes a record of the incident. In addition, it’s recommended that you file a separate report with your local law enforcement agency. But that’s not all. You should contact an experienced, qualified, and proven car accident lawyer as soon as possible to file a DoorDash personal injury claim. This will allow you to pursue what is often much-needed financial compensation for things like hospital/medical bills, lost wages, pain and suffering, and emotional trauma. On that note, it’s important to remember to always seek medical treatment immediately after a DoorDash driver accident. By waiting to get the medical care you need for your DoorDash car accident injuries, you not only jeopardize your health – you jeopardize the potential value of your personal injury civil claim.

  • Can I Sue DoorDash for an Accident?

DoorDash drivers, like all individuals sharing the roadways, have a duty of care to the other motorists, pedestrians, and bicyclists. Accordingly, you absolutely have the right to sue a DoorDash driver (and potentially the delivery company directly) for a car accident injury that’s due to negligence. If you’ve suffered an injury due to a DoorDash driver’s negligence, you may be entitled to maximum financial compensation for things like pain and suffering, lost wages, and medical care costs. Furthermore, in the tragic instance where a DoorDash driver kills a loved one in a car accident, you may be eligible to file a wrongful death lawsuit for damages.

  • Can I Sue if a DoorDash Driver Crashed Into Me?

Whether you were driving your car, operating your motorcycle, on a scooter, or simply walking as a pedestrian, if a DoorDash driver crashes into you through no fault of your own, you not only have the right to sue – you may be able to recover substantial financial compensation for any injuries or ensuing harm. The best way to ensure that you receive the maximum financial compensation you deserve is by contacting an experienced car accident or delivery driver accident lawyer immediately after the incident.

  • I am a DoorDash Driver and I got Into an Accident. What do I do?

If you’re a DoorDash delivery driver who was involved in a car accident, you should immediately seek medical attention for any injuries. Moreover, you should file a claim with DoorDash directly – either through your employee app or by calling the company’s insurance carrier, Blue Star Claims, at 480-579-2405. Additionally, you can complete a claims form at www.bluestarclaims.com or by sending an email to DDintake@bluestarclaims.com. Before making a statement or admitting any fault in the accident, however, it’s recommended that you consult with a personal injury attorney. • What is DoorDash Driver Insurance Coverage?

According to DoorDash’s occupational accident policy, drivers who suffer injuries while making a delivery with the company may be eligible for the following coverage (*Dashers do not need to sign up or enroll for occupational accident insurance in order to be covered, and there are no premiums, deductibles, or co-pays).

  • Occupational accident insurance offers several important protections for Dashers involved in covered accidents:

    • Medical expenses: Up to $1,000,000 with no deductible or co-pay
    • Disability payments: 50% of average weekly wage up to a maximum allowance of $500.00 per week minus other income
** California residents: DoorDash recommends that you review the company’s schedule of benefits
    • Survivors payments: Up to $150,000 for eligible dependents
  • What is the Average Case Value of DoorDash Accident Cases?

DoorDash car accident claims can vary in terms of overall worth. Depending on the severity of your injuries, your claim may of very high value. For example, cases with severe to catastrophic injuries may be worth hundreds of thousands to millions of dollars. If you’ve suffered a serious injury that required you to undergo substantial medical care, miss time from work, and endure pain and suffering, your case may be worth such an amount. The best way to determine the value of your DoorDash car accident injury claim is by contacting an experienced attorney for a free consultation.

  • How to File an Accident Claim with DoorDash Insurance

DoorDash’s website confirms that if your injury occurred on or after June 27, 2019, you may file a claim using the following reporting options:

  • Online: www.bluestarclaims.com (complete intake and claim forms to start your claim).
  • Phone: (480) 579-2405 (Available 24/7/365)- Dedicated to DoorDash
  • Email: DDintake@bluestarclaims.com (indicate availability, leave your phone number for a callback, or request claims forms to be sent to expedite the claim process).

All coverages are subject to the policy terms, conditions, limitations, and exclusions. If there is a conflict between the information shown here and the actual insurance policy, DoorDash states that the policy will govern. However, as indicated above, it’s recommended that you consult with a personal injury lawyer before admitting fault, making an official statement, or accepting any type of cash settlement offer for your DoorDash car accident injuries.
